Summary

This ordinance approves the termination and dissolution of the Phase II Broadway Pedestrian Mall Local Maintenance District (LMD). This LMD was created in 1993 for the care, operation, repair, maintenance, and replacement of local public improvements such as trees, landscaping, trash receptacles, and streetscape furniture along specific sections of Broadway and Alameda Avenue in Council District 7. The dissolution is occurring because a new entity, the Broadway Denver General Improvement District (GID), was created by Ordinance No. 917, Series of 2025, and approved by electors on November 4, 2025. Since the Broadway Denver GID encompasses substantially all of the property within the Phase II Broadway LMD, its dissolution avoids duplication of services. Remaining funds from the Phase II Broadway LMD, after paying outstanding expenses, will be transferred to the Broadway Denver GID and must be used within the former boundaries of the Phase II Broadway LMD. The Broadway Denver GID will assume responsibility for the maintenance of public improvements previously managed by the Phase II Broadway LMD. Additionally, Ordinance No. 25-1728, Series of 2025, which provided for 2026 assessments on property owners within the Phase II Broadway LMD, is repealed, meaning no 2026 assessments will be imposed.

Residents in the affected area will no longer pay assessments for the Phase II Broadway LMD in 2026, as the previous assessment ordinance is repealed. The maintenance of local public improvements will be transferred to the new Broadway Denver General Improvement District, ensuring continued upkeep without duplication of services.
