Summary

This ordinance approves the termination and dissolution of the Broadway Pedestrian Mall B Local Maintenance District (Broadway B LMD). The Broadway B LMD, established in 1998 and located along South Broadway between Center Avenue and Ohio Avenue in Council District 7, was responsible for maintaining trees, landscaping, trash receptacles, streetscape furniture, and other public improvements. Its dissolution is necessitated by the recent creation of the Broadway Denver General Improvement District (Broadway Denver GID) via Ordinance No. 917, Series of 2025, which was approved by electors on November 4, 2025. Since the Broadway Denver GID encompasses substantially all of the property within the Broadway B LMD, it will assume responsibility for the maintenance of these public improvements to avoid duplication of services. Any surplus funds remaining in the Broadway B LMD's accounts after paying outstanding expenses will be transferred to the Broadway Denver GID and must be used within the former boundaries of the Broadway B LMD. Additionally, this ordinance repeals Ordinance No. 25-1727, Series of 2025, meaning no 2026 assessments will be imposed on property owners within the Broadway B LMD.

Residents and property owners in the former Broadway Pedestrian Mall B Local Maintenance District will no longer pay assessments for its maintenance, as the responsibility and remaining funds are transferred to the new Broadway Denver General Improvement District.
