Consideration of approval to authorize the County Judge to execute Amendment No 3 to the RESTORE Act Texas City Hurricane Protection Levee Repair grant, Contract Number 582-20-11883 submitted by the County Engineer

This Amendment No. 3 to Contract Number 582-20-11883 between the Texas Commission on Environmental Quality (TCEQ) and Galveston County extends and increases federal funding for the "Texas City Hurricane Protection Levee Repair I" project.

Key Changes:

• Project Extension: The expiration date is extended from December 31, 2025, to June 30, 2026.
• Increased Funding: The maximum authorized federal reimbursement amount is increased by $200,376, bringing the total federal grant to $6,729,336. Including Galveston County funds of $1,758,146, the total project budget is $8,487,482.
• Budget Reallocation: Phase 1 (Tide Gate Evaluation & Specifications) saw a decrease of $115,870, with these funds reallocated to Phase 2. Phase 4 (Levee Roadway Rehabilitation) received an additional $200,376 to offset construction cost increases due to inflation and the need for base material stabilization (Cement and Cement treatment).
• Updated Terms: Federal grant terms and conditions are updated to the October 2024 version. The project is also exempt from the Build America, Buy America Act (BABAA) requirements due to a public interest waiver.

This amendment ensures the continued progress of critical hurricane protection infrastructure, with various phases including tide gate coating, pump station engine replacement, and levee roadway rehabilitation, scheduled for completion by January 14, 2026, and June 30, 2026 for the tide gate coating.
