Summary
This ordinance authorizes the Mayor or her designee and the Corporation Secretary to execute and deliver three easements between JEA (Grantor) and the City of Jacksonville (Grantee). These easements are:
- Drainage Easement: A perpetual, non-exclusive easement for stormwater drainage purposes, including grading activities, over JEA property.
- Non-Exclusive Grant of Easement (Cosentino Sidetrack): Grants the City authority to construct, operate, maintain, and repair a single sidetrack for rail freight traffic, potentially allowing third-party use. This easement has a 24-month termination clause after the associated Rail Spur Agreement expires and requires the City to manage JEA's utility operations and safety.
- Temporary Construction Easement: A temporary easement for grading and workspace to facilitate the construction of the sidetrack and related public works improvements.
The Office of Economic Development will oversee these easements. One-cycle emergency passage is requested because construction is anticipated to begin immediately to meet state grant timelines, requiring the easements to be in place beforehand. The ordinance specifies that the City will be responsible for its contractors' insurance and indemnification of JEA.
This action facilitates the construction of a rail sidetrack and related improvements, which is necessary for meeting state grant timelines and is expected to have no direct cost to the City. Residents may experience temporary construction impacts in the vicinity of the easements.
