Motion (Padilla – Price) relative to creating process for implementing licenses for Cultivation and Delivery to the public.

This motion directs the Department of Cannabis Regulation (DCR) to report on a process for implementing licenses for Cultivation and Delivery of cannabis to the public. The City Attorney is requested to draft an ordinance based on DCR's proposed process. This action is necessary to modernize the City's cannabis ordinance, which has not been comprehensively updated since 2017 for delivery and 2018 for cultivation. The current framework has misalignment with state regulations, and the City has not opened application windows for general applicants for these license types, operating under a Social Equity Applicant-only framework. Modernizing these licensing opportunities is expected to increase legal market participation, generate new tax revenue, and support compliant operations. Delivery accounts for approximately 25% of cannabis sales, highlighting the importance of updating the local framework to reflect consumer behavior and capture taxable sales from the illicit market. The motion was presented by Councilmember Padilla and seconded by Councilmember Price on March 3, 2026.
