This resolution amends Ordinance No. BL2021-874 to extend the construction commencement date for an easement agreement related to Alley 371. The original ordinance authorized the abandonment of a portion of Alley 371 and granted an air-rights easement to Q & A Holdings, GP (the Developer) for a development project at 302 McMillan Street and 301 15th Avenue North. The easement agreement required construction to commence within five years of the August 2, 2021, effective date. Due to unforeseen conditions, the Developer requested an extension. This amendment extends the construction commencement period by two additional years, from five to seven years from the original agreement date. The Developer paid $30,000 for the easement.

This extension allows the developer more time to begin construction on a project that includes an easement over Alley 371. Residents may experience construction delays related to this alley and adjacent properties if the project proceeds.
