Summary

The City Council is considering a resolution to authorize the use of eminent domain proceedings for the acquisition of right-of-way necessary for the Kohlenberg Road Improvements Project. This project aims to improve pedestrian safety and ADA accessibility by adding sidewalks on both sides of the road, enhance connectivity between residential and commercial areas, and alleviate traffic congestion. The resolution specifically targets three parcels of land owned by Lynn K. Wohlfahrt, encompassing both fee simple interests and a temporary construction easement. If negotiations with the landowner are unsuccessful, the city will pursue condemnation to acquire the necessary property.

This action could lead to the involuntary acquisition of private property for public use if negotiations fail. Residents may experience disruptions during the construction phase of the Kohlenberg Road improvements, which aim to enhance safety and traffic flow.
