Summary

This item approves a Conditional Use Permit (CUP) for STIIIZY to operate a retail cannabis business at 13041 San Pablo Avenue (APNs: 526-020-011, 526-020-014, & 526-020-015) in an existing 5,639 sq ft commercial building within the Commercial Mixed Use District (SP-2). The Planning Commission approved the CUP and a parking reduction on March 24, 2026, following a comprehensive application process that began with voter approval of a cannabis business tax in November 2024 and subsequent city ordinance amendments in March 2025 establishing land use standards.

Key Project Details: The project involves the adaptive reuse of a currently vacant commercial building, with STIIIZY occupying a 3,111 sq ft ground floor sales area. The site provides 19 dedicated on-site parking spaces, meeting zoning requirements, and benefits from an additional 7 adjacent on-street spaces. The project is deemed categorically exempt from CEQA as it involves negligible expansion of an existing facility.

Operational & Security Measures: Operating hours are 8:00 a.m. to 10:00 p.m. daily. The business will employ 15-25 staff, with a commitment to hire at least 70% from San Pablo residents. Extensive security protocols include 24/7 motion-sensored video surveillance (90-day retention), remote police access for law enforcement purposes, on-site licensed security guards during operational hours, panic buttons, and bollards. Odor control utilizes carbon filters and a negative air pressure system. Deliveries are permitted from 8:00 a.m. to 10:00 p.m. using unmarked vehicles, with cashless payment required at the delivery location.

Community Benefits & Mitigation: STIIIZY commits 1% of annual gross revenues to two local non-profits. Other benefits include a Collective Bargaining Agreement with UFCW, free college-credit workforce development courses for employees, a youth cannabis prevention program, and compassionate care initiatives for veterans. Measures to mitigate off-site impacts address noise, light, odor, public consumption, loitering, litter, and traffic, with a dedicated complaint response procedure.
